The purchase of products from this web site is governed by these terms and conditions. By accessing the site you agree to be bound by these terms and conditions. Contained in our terms and conditions are details of current regulations governing online shopping. Please read them carefully as they contain important information. If you intend to purchase from our site we recommend that you print a copy of these terms and conditions. We reserve the right to change, modify, substitute or remove, without notice, any information on this site as necessary.

About Shop on the Beach Mail Order Service



We aim to deliver the best possible customer experience and we therefore adhere to all current and proposed legislation in addition to trade body guidelines. The conditions detailed below do not affect your statutory rights. These include all of the current guidelines relating to the information that we hold about you and, in order to clarify this, we have a published privacy statement.

Privacy Statement



We are committed to protecting your privacy. We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998. We collect information about you in two ways: a) Through the use of automatic tracking devices. We use software on the website that collects statistics such as how many people are visiting the site, which pages they are looking at and how long they are spending on the site. This information is anonymous and is used only in order for us to understand visitor needs and improve the site. b) When you request a specific service, such as subscription to our newsletter. The type of information we collect this way may include your name, address, phone/fax number and email address. Information gathered for this purpose will never be used for any other purpose or shared with any other companies. We will always give you the option to unsubscribe from our newsletter facility by clicking the 'Unsubscribe' button that appears on each newsletter. We will never collect sensitive information from you without your explicit consent. The information we hold will be accurate, relevant and up to date. You can check the information that we hold about you by emailing us or phoning us on 01637 860051. Any inaccuracies will be corrected promptly. We will never disclose any information about you to any third party. When you visit some areas of our website, a 'cookie' will be placed on your computer. Products



All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. Products and packaging are subject to change or substitution without prior notice. Every effort will be made to dispatch the items specified.

Back Orders



If an item is out of stock we will email you with the option either to cancel your order or, having told you when we can fulfill it, to wait for delivery.

Methods of Payment



We can only accept payment in pounds Sterling. We accept Visa, Mastercard, Maestro and Visa Debit. If you are paying by Maestro you will also need to include the card issue number or start date. All prices are inclusive of VAT (where applicable) at the current rate and are correct at the time of input. Some products contain some zero rated goods and the consolidated VAT rate is then reduced accordingly. We reserve the right to amend prices subject to change in the rate of duty. The total cost of your order is the price of the products including delivery charges. All orders are positively credit card sanctioned prior to dispatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given. In the unlikely event that your payment card is used fraudulently to make a purchase with The Shop on the Beach Mail Order Service you, the consumer, are entitled to cancel the said payment(s). If payment has already been made, you, the customer, are entitled, in accordance with the standing Consumer Protection Distance Selling Regulation (2000), to a re-credit or to have all sums returned to you by the card issuer.

Cancelling your Order



We operate a policy for cancellation to allow you a cooling off period after placing your order. In accordance with the Distance Selling Directive (2000) you may cancel your order at any time without reason within 7 working days of delivery. You may cancel your order for any reason provided: -

You or the recipient notifies us of your cancellation in writing/ e-mail to the address on our "contact us" page within seven working days of delivery.

The goods remain unused and component parts are unopened.

You or the recipient retain and take reasonable care of the goods until returned.

You return packaged item(s) to Returns at The Shop on the Beach Mail Order Service to the address on the "contact us" page.

Please be aware that you will be responsible for any postage/carrier costs incurred in sending goods back to the Shop on the Beach. We recommend that items being returned be sent via insured, trackable delivery for your protection. A refund can only be provided for items received back by us.

On receipt of the goods, The Shop on the Beach will give you a full refund of the amount paid (less the delivery charge) or an exchange/credit as required. Refunds can only be credited back to the original card that the goods were bought with. Please note that refunds for items bought as gifts can only be given to the original payer, and that if you decide to swap an item we can't stop the payer knowing. On return of goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount /offer threshold. The Shop on the Beach can arrange for delivery of replacement products to you if required; this constitutes a separate contract between you and The Shop on the Beach. In this case, a charge will be made by The Shop on the Beach for packing, handling and delivery of goods. This does not affect your statutory rights.

Refunds and Exchanges



Should you find that the goods you've purchased from us are unsuitable/do not fit etc, they can be returned for a prompt refund or exchange if they are received back at the address below within 21 days, in new condition, with the original packaging, labelling and Shop on the Beach receipt. The 21 days start from the day of dispatch, but as a minimum includes a period of 7 working days from the day after delivery to you as the permitted cancellation period. We will provide a refund or exchange within 30 days of receiving the returned goods. We recommend that items being returned be sent via insured, trackable delivery for your protection. All return postage charges must be met by the customer, unless he or she is returning the goods due to a fault. In the case of warranty returns, goods must be clean and free from dirt and mud to comply with the current Health and Safety Regulations. DVDs, videos and books are non-exchangeable and non-returnable, unless incorrect or defective. All of the above does not affect your statutory rights as a consumer.
